Specific aspects in dismissal during a state of emergency and extraordinary epidemiologic situation

The paper examines the implication of the legislation adopted during the state of emergency and during the extraordinary epidemiologic situation because of Covid–19 on the dismissal regime. The study concludes that the variety of newly introduced regulations do not influence the right of the employer to dismiss employees and has no impact on the expiry of the dismissal notice. The economic difficulties caused by the implemented restrictions lead to an increased number of dismissals on the grounds of art. 328, para 1, p.p. 1–4 and p.12 of the Labour Code. Court decisions which establish contradictory court practices and the imposed restrictions by the state of emergency as a formal ground for dismissal are being analyzed. Special focus is put on the practices for introduction of mass discharges in a state of emergency by employers.
