Защита на основните права в правото на Европейския съюз

Абстракт

Като изяснява контекста на формиране и развитието на правния режим за защита на основните права в правото на ЕС до придаване на обвързващо действие на ХОПЕС, настоящата студия има за предмет да изследва какви основни положения в механизма на защита произтичат от Хартата и какви основни тенденции на еволюция в този механизъм се очертават през първите години от прилагане на Хартата като основен елемент на правния режим на защита на основните права в Европейския съюз. Студията разглежда изведените от висшата интеграционна юрисдикция разрешения относно определяне обхвата на действие на Хартата, особените правила на тълкуване на уредбата, установена в нея, разграничаването на реда на защита на същинските субективни права и правата-принципи и условията за налагане на ограничения на основните права.

Акцент в изследването е поставен върху очертаната линия на ограничителен прочит от страна на Съда на ЕС на някои основни положения, определящи прилагането и ефективността на правния режим за защита на основните права в правото на ЕС, като е защитено разбирането, че преодоляването на тази „съдебна политика“ относно еволюцията на основните права и утвърждаването на високо равнище на защита спрямо националните механизми за защита в държавите членки и спрямо достиженията в международен план, е от решаващо значение за запазване на легитимността на ЕС в очите на гражданите и за утвърждаването на Съюза като общност, основана на върховенството на правото.
