Protection of the fundamental rights in European Union law

Essential elements in the legal framework for protection of the fundamental rights since the entry into force of the Charter of the fundamental rights of the European Union

Abstract

Clarifying the context of development of the EU mechanism for protection of the fundamental rights until the binding effect of the Charter, the present study aims to examine what key provisions in the protection mechanism derive from the Charter and what main trends of evolution in this mechanism emerge in the first years of application of the Charter as a key element of the legal regime for the protection of fundamental rights in the European Union.

The study examines the rulings derived by the Court of Justice on the scope of application of the Charter, the specific rules of interpretation set out therein, the distinction between the protection of genuine subjective rights and the rights-principles and the conditions for imposing limitations on fundamental rights.

The research focuses on the outlined line of restrictive reading by the Court of Justice of some key provisions determining the application and the effectiveness of the legal regime for protection of fundamental rights in EU law, while defending the understanding that overcoming this „judicial policy“ on the evolution of the fundamental rights protection and the establishment of a high level of protection vis-à-vis of the national protection mechanisms and the international achievements is crucial for preserving the EU’s legitimacy in the eyes of citizens and for strengthening the Union as a community based on the rule of law.
