Abstract

The study clarifies the nature of genocide as an international crime, based upon the case law as developed after the Second World War by the international war and criminal tribunals and the International Criminal Court, also acknowledging the achievements of European legal and global historical science. It strives to contribute to the international professional discussion by assisting the resolution of a number of points of discussion – related to the elements of the crime and its differentiation from similar phenomena – by applying the analytical standards of the Bulgarian penal-law system which provide some advantages in introducing terminological and conceptual clarity in areas of deficit of internationally recognised terminology standards and to offer valid criteria for differentiation between similar phenomena.
