The principle of good administration in the EU law and the АPC

Abstract

In addition to those principles which are traditional of Bulgarian administrative law, such as the principle of ex officio, equality, autonomy and impartiality, basic principles of the EU law have also been proclaimed in the Administrative Procedure Code (APC) in view of the accession of the Republic of Bulgaria to the EU. Either in whole or in part – through some of their components – these principles are new to Bulgarian administrative law. One of them is the principle of good administration. The case law of the Court of Justice of the EU has affirmed good administration as a general principle of the EU law, and Art. 41 of the Charter of Fundamental Rights of the EU regulates good administration as a complex right, the components of which are rights that represent principles of the EU administrative law. In the APC, the principle of good administration is not separately proclaimed; yet, its elements form part of the content of other principles regulated by the Code, namely those of legality, proportionality, transparency, impartiality. The disclosure of the content of this principle and its regulation through the APC makes it possible to establish the significance of its components for determining the essential characteristics of the principles that these components form part of, as well as to establish whether their application is guaranteed by the framework governing the administrative procedural rights and obligations of the parties and the ruling authority in the proceedings under the Code.
